ITEM:  Correspondence & Reports

The Commission had a brief discussion regarding the different law suits they received in their package.

A letter was sent to Mr. Martel of 461 Miller Road.  This letter discussed what was agreed upon by Mr. Martel and Jeff Folger regarding the activities that occurred within the wetlands at 461 Miller Road (Attachment A).

Chairperson Warren informed Commission members that when exiting Town Hall by the main access, there will be a right hand turn only onto Sullivan Avenue.

ITEM:  Minutes

The minutes of October 1, 2003 and October 15, 2003 (with amendments) were approved by general consensus of the Commission.

ITEM:  New Business

Appl. #03-78P – Martin House Lot – 10 Robin’s Wood Way, RR-Residential zone.

Mr. Jay Ursery of JR Russo & Associates came before the Commission to represent Blake and Lisa Martin.  This is an application for a single family residence that will be located at 10 Robin’s Wood Way.  There is a small wetland just over 3,000 square feet.  The house and driveway encroaches into the 80 foot upland review area.  There is a drainage pipe that is located just off of the north west corner of the wetland, which goes underneath the driveway to a much larger wetland area.  When the pipe was constructed, it was pitched the wrong way and creates ponding.  This ponded area has taken on wetland characteristics.


Answering questions from the Commission, Mr. Ursery explained that the change with the level spreader will be added to the plans.  Alternative plans were discussed, but either the wetland would be encompassed by black top or 90% of the house would be in the regulated area.  There will be a pretty good buffer out there.

Mr. Blake Martin came before the Commission.  He explained that they would like to maintain as much natural buffer as possible.

Motion to:      approve with conditions appl. #03-78W - - Martin House Lot – 10 Robin’s Wood Way – Inland Wetland/Conservation Commission application to build a house on an approved residential lot.  RR, Residential zone.

The vote was as follows:  unanimous

Conditions:

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

3.      The permit is valid for five years and shall expire on October 1, 2008.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

5.      A contact person shall be identified on the plans.

6.      Shorten the drain to locate the level spreader no closer than 30 feet from the wetland, and reduce the proposed clearing accordingly.

Jurisdictional Ruling – Handicapped Accessible Trail at the Donnelly Land Preserve

Commissioner Phillips stated that section 4.2b covers the disturbance of approximately 1,500 square feet of the 40 or 50 acre wetland.  The disturbance will not disturb the overall character of the wetland.

Motion to:      move that the proposed activity meets the regulation of 4.2b and should be considered non-regulated activity.

The vote was as follows:  unanimous

Commissioner Kelly felt that the gravel that is proposed to be placed on the trail should not be compacted by foot traffic and will not interfere with infiltration.  Commissioner Kelly also stated that she feels the Town should stabilize the slopes.

ITEM:  Old Business

Appl. #03-67P – Mill on the River

Chairperson Warren stated she has gone back to the site twice this week and has found that the silt fences are still unacceptable.

Commission members discussed this situation briefly stating that the applicant had two weeks to remedy this situation and has not done so.  The Commission felt the only decision that could be made is to deny the application and send out a violation letter.

Motion to:      deny appl. #03-67P – Mill on the River – Inland Wetland/Conservation Commission application to create an auxiliary parking lot across the street from the restaurant.  RR, Residential zone.

The vote was as follows:  unanimous

Ms. Karen Isherwood from Design Professionals asked the Commission if she would have ten days to remedy this situation, or avoid any further action.  Commissioner Forzley recommended that anything that is planned should go through Jeff Folger.

ITEM:  Old Business

Holiday Party

The Commission decided that the holiday party would be held at Calamari’s on Wednesday, January 14, 2003 beginning at 6:00 p.m.
